September 2, 2003 Meeting Minutes

1.         CALL TO ORDER

Chairman F. Phillips called the meeting to order at 8:03 p.m.

 

2.         MINUTES OF August 19, 2003

After some revisions were made to the draft minutes, Commissioner Gould motioned to approve the August 19, 2003 meeting minutes, Commissioner Acuna seconded. Ayes, all; Nays, none; motion carried.

 

3.         Public Hearing for the consideration of a request for a Special Use and any additional relief necessary to expand the existing Hillcrest Country Club facility, located at 3217 Route 53, submitted by Hillcrest Country Club.

 

Present at the hearing representing Hillcrest Country Club was Architect Frank Gutowsky        Mike Krabbe General Manager, and Edward Hockfield President of Hillcrest Country Club.  Mr. Hockfield who is a residence of Long Grove at 2429 RFD Country Club Estates presented the addition and remodeling project to the Plan Commission. Hillcrest Country Club proposes changes to the existing clubhouse by enclosing an existing dining area, changing the rear elevation exterior finish, and expanding the existing outdoor patio seating area.  

 

Village Superintendent Block and Village Planner Ed Cage did meet on site with Hillcrest Country Club representatives to go over the area for the addition and the location of the remodeling that will take place.

 

Commissioner Gould had a question if there is currently outdoor dining and the response from the petitioner was yes. Commissioner Gould had a concern on any noise amplification. Commissioner Fasano had the same concern about any noise and the use of outdoor seating shall follow the Village standards for outdoor dining and allowable noise level. Commissioner Acuna questioned if there will be any music and to what extent any noise. Petitioner responded that there will be no outside music or speakers. Commissioner Acuna asked what the current outdoor seating area was and the response was 32 persons.

 

Commissioner Fasano asked when construction would take place and what was the time frame for the project and the petitioner indicated they would like the contracts let out by October 1, 2003.  Commissioner Gould requested that the petitioner comply with the construction hours permitted in the Village Code and the petitioner committed to complying with these regulations.

 

After some discussion on what will take place on the outdoor seating/dining area, Commissioner Acuna made a motion to recommend to the Village Board an amendment to the Special Use Permit to allow the expansion of the outdoor seating/dining area including expansion of outdoor patio for the existing clubhouse. The motion was to include no outdoor noise amplification and seconded by Commissioner Lisa Phillips. Ayes, all. Nays, none, motion carried.

 

4.         Continued Public Hearing for a Text Amendment and Special Use to operate a Day Care Center for approximately 22 children within the existing residence located at 7155 Route 83 (lot#29 Towner Subdivision).

 

The first portion of the public hearing is a text amendment to the Village of Long Grove Zoning Regulations to allow a Special Use to operate a Day Care Center in the B2 Suburban Business District.

 

Present at the meeting representing the Day Care Center was Attorney Elliott Hartstein and owner Dimitry Makhovik.  Attorney Elliott Hartstein presented a response to the questions asked by the plan commission members.

 

  1. Enclose the wood fence area with a gate in the rear yard.
  2. Move play area closer to the house.
  3. Add a drop off area.
  4. Contacted Lake County Health Department for septic system approval to be submitted.
  5. Two existing Towner’s subdivision community water wells serve the property.
  6. Existing outdoor storage shed is to be removed.
  7. Staff requested a revision to the drop off area with a larger turnaround radius.

 

The Commission discussion on the text amendment to include a Day Care Center in the B2 zoning district as a Special Use, Commissioner Acuna made a motion to recommend to the Village Board a Text Amendment to the B2 Zoning District to include a Day Care Center as a Special Use, motion seconded by Commissioner Dvorak. Ayes, all. Nays, none, motion carried.

 

The second portion of the Public Hearing was a Special Use to operate a Day Care Center for approximately 22 children within the existing residence located at 7155 Route 83 (lot #29 Towner Subdivision).

 

There was discussion on building regulations and fire code regulations.  Village Superintendent Block responded to the commissioners that the Village will review the code requirements for the facility and the requirements of Illinois Department of Children and Family Services and the Office of the State Fire Marshall.

 

Commissioner Lisa Phillips had a concern on the safety hazard of vehicles able top turnaround on the property without backing out on to Route 83.

 

The proposed front buffer yard adjacent to Route 83 was in compliance with the Village standards Commissioner Gould questioned the parking spaces and their location as indicated on exhibit B drawing, and whether this parking would be sufficient with the majority of children be dropped off and picked up.

 

There was a lengthy discussion of Zoning Regulations section 5-11-6 Special Uses (D) Standards and that it was important that items 1-4 are met to allow a Special Use.

 

Commissioner Lisa Phillips requested a scaled drawing with dimensions of the site plan to be submitted for review. It is questionable if exhibit B drawing is a true and accurate dimension.

 

Commissioner Fasano asked Village Staff to verify that this is the best layout for parking and turnaround on the property for the day care facility.

 

Commissioner Gould questioned if the sign size advertising the facility is in compliance with the Village Code.

 

Attorney Hartstein indicated there will be three employee vehicles on the property at any one time and one of them will be in the garage.

 

Commissioner Dvorak expressed concern on the amount of space on the property utilized for parking may not be enough. Commissioner Dvorak recommended staff provide their professional opinion on a safe ingress and egress for the property.

 

The Commission offered the petitioner an opportunity to come before the Plan Commission and the Special Plan Commission meeting if the parking plan had been addressed in an appropriate manner and addressed the Plan Commissioners’ concerns.

 

Commissioner Fasano recommended a site plan with parking layout with scaled dimensions be submitted.  Commissioner Lisa Phillips and Commissioner Acuna recommend a site plan to scale dimensions be submitted for review before accepting the parking layout and turnaround area on the property. Commissioner Acuna recommend commissioners e-mail to staff with direction to revise the site plan and petitioner submit scaled site plan to staff. Commissioner Acuna was assigned to work with staff.

 

Commissioner Lisa Phillips expressed concern for the safety of the children attending the facility, the safety of the children given the proposed drop-off area design and an additional concern of vehicles being backed up onto Route 83.

 

Commissioners continued a lengthy discussion on stacking of vehicles and the procedure and space for the dropping off of children being a safety issue.

 

Commissioner Fasano motioned to continue the public hearing to September 16th, 2003 Special Plan Commission meeting subject to the petitioner submitting a revised plan for the access to the property and parking on the property.  Commissioner Gould seconded the motion. Ayes, all.  Nays, none, motion carried.

 

5.         Continued Public Hearing for the consideration of a request for a Special Use, Text Amendment and any additional relief necessary to install a second cellular monopole and related equipment on the Christ’s Church Property, located at 5105 Arlington Heights Road., submitted by T-Mobile.

 

Mark Wilson representing T-Mobile presented reasons to construct the cell tower at 5105 Arlington Heights Road.

 

Chairman F. Phillips opened up the hearing to any public opinion on the installation of the cell tower at 5105 Arlington Heights Road.

 

Sunnie Gilbert (realtor), 1138 Cortland Drive, Buffalo Grove, had a concern about having the cell tower at this location for property values and being a health hazard.

 

Shelie Franks, 1134 Courtland Drive, Buffalo Grove, object to any other cell tower going up at this location.

 

Gerald Ostick, 5109 Arlington Heights Road, Long Grove, objects to the cell tower being constructed. The tower will be an unsightly eyesore to have another cell tower at this location.

 

Monica Bedrasian, 5129 Arlington Heights Road, Long Grove, objects to the cell tower being constructed. This is not the Long Grove image to have a cell tower at this location.

 

Paul Kashian, 1130 Cortland Drive, Buffalo Grove, objects to cell tower being constructed. His main concern is the cell tower being a health hazard.

 

Gale Norkus, 1136 Cortland Drive, Buffalo Grove, objects to the cell tower being constructed. The cell tower belongs in an industrial area and not residential.

 

Haig Bedrasian, 5129 Arlington Heights Road, Long Grove, objects to the cell tower being constructed.  His concern is the tower will be a health hazard.

 

Mark Wilson – T-Mobile, responded that property value studies have shown that the construction of cell towers is not an issue.

 

Village Attorney Tappendorf responded on the Federal Government regulations and Supreme Court decision do not consider the construction of cell towers as being a health hazard and is not a reason to not accept the location of a cell tower.

 

Aseem Dayal – T-Mobile, presented technology of cell phone use and specifications.

 

Erica Baldzr – T-Mobile, responded that the location of cell towers outweighs the esthetic look of the cell tower.   T-Mobile presented a number of complaints received within the Long Grove area for the need to construct the cell tower at the 5105 Arlington Heights Road location, because of the dead zones in the area for no service.

 

Commissioner Gould expressed concern that a number of previous issues presented to the petitioner that were identified by the Plan Commission in December 2002 have not been responded to, including the demonstration of need, the evidence of problems with dropped calls and that all potential options had been eliminated and why.

 

Commissioner Dvorak questioned the location of the cell tower and distance to property line is not in compliance with Village Code.

 

Commissioner Jenkins questioned if a number of small towers would be acceptable instead of the one tall tower. Mark Wilson – T-Mobile, responded that trees and structures effect the use of low profile cell towers.

 

Commissioner Fasano asked the question as to the limitation of how many cell antenna equipment be installed on the existing cell tower on site and the number of carriers per tower. Commissioner Fasano also raised the issue of Federal Government regulations on cell towers.

 

Commissioner Lisa Phillips had a concern about the location for the new cell tower is the absolute location for it and about creating a precedent and grouping such towers and essentially creating cell tower “farms”.  Commissioner Lisa Phillps also questioned the dropped call data that was presented to the Plan Commission, noting that it was inconsistent and did not necessarily support the need for a cell tower at that location. 

 

Commissioner Acuna expressed concern on the technology and location of cell towers that other communication systems may require additional towers at the existing site.  A lengthy discussion continued between commissioners on the cell tower location, Commissioner Acuna questioned if the option of other cell towers have a plan for T-Mobile installation in the area. Discussion on existing cell towers in the area and their capacity, dropped calls, and coverage.

 

Commissioner Lisa Phillips made a motion to continue the public hearing for the cell tower to October 7th,  2003 meeting. The petitioner needs to submit documentation on capacity and dropped calls data and other locations for cell towers to be located and submit colored drawings for commissioner’s packet. Commissioner Gould seconded the motion. Ayes, all. Nays, none, motion carried.

                 Next Regular Meeting, Tuesday October 7, 2003 at 8:00 p.m.
