November 4, 2003 Meeting Minutes

 

 

Chairman present:  Fred Phillips.

 

Commissioners present: Joseph Di Iorio, Michael Dvorak, Nicholas Fasano, Camy Gould, Robert Jenkins and Lisa Phillips.

 

Commissioners Absent: Ed Acuna.

 

Also Present: Village Planner Edmond Cage.

 

1.         CALL TO ORDER

Chairman Fred Phillips called the meeting to order at 8:02 p.m.

 

2.                  MINUTES OF October 7, 2003

There were some changes made to the draft meeting minutes from October 7, 2003 meeting minutes.  Commissioner Fasano motioned to approve the revised October 7, 2003 meeting minutes with the proposed changes, Commissioner Lisa Phillips seconded.  Ayes, all.  Nays, none, motion carried.

 

3.         Continued Public Hearing For a Text Amendment and Special Use Permit to Operate a Day Care Center for Approximately 22 Children Within the Existing Residence Located at 7155 RFD (Lot #29 Towner Subdivision), Submitted by Dmitriy Makhovik. 

 

The Petitioner had not submitted the traffic study as requested by the Plan Commission and the Petitioner had requested that this petition be tabled until the next regularly scheduled meeting on December 2, 2003.  Commissioner Lisa Phillips motioned to continue the public hearing to December 2, 2003.  Commissioner Dvorak seconded, Ayes, all.  Nays, none.  Motion carried.

 

4.           Continued Public Hearing for the consideration of a request for a Special Use, Text Amendment and any additional relief necessary to install a second cellular monopole and related equipment on the Christ’s Church Property, located at 5105 Arlington Heights Road, Submitted by Voice Stream Wireless. 

 

The Petitioner had requested that this petition be tabled until the next regularly scheduled meeting on December 2, 2003.  Commissioner Gould motioned to continue the public hearing to December 2, 2003.  Commissioner Fasano seconded, Ayes, all.  Nays, none.  Motion carried.

 

5.               Continued Public Hearing for the Consideration of a Text Amendment that would Permit Outdoor Dining as Either Temporary Uses or Special Uses within the B-1 Historic Business District. 

 

Village Planner Cage outlined the changes made by the Village Attorney and outlined why some of the requested changes were not made to the draft ordinance.  Changes were made to page 2 of the draft ordinance as follows, number 2, the capacity of patrons was changed from 20 to 24, number 3, the distance was changed from 500-feet to 300-feet and letter C, the “as part of the principal use” was eliminated and “that is ancillary to a primary restaurant use and that is conducted within or on a permanent structure” verbiage was added.  Additional changes were made to page 3 of the draft ordinance, number 3, the verbiage “area of the” was eliminated and number 4, the verbiage “Plan Commission” was eliminated and “Village” verbiage was added.

 

Commissioner Lisa Phillips still had a concern with number 6 on page 2 of the draft ordinance concerning lighting.  Village Planner Cage distributed an illustration highlighting the difference between the 300-foot and 500-foot setback within the B1 Historic Business District.  The illustration highlighted that the initial setback of 500-feet would be too restrictive within the B1 Historic Business District and that 300-feet would be a more appropriate distance.  The Plan Commission agreed.

 

Commissioner Gould motioned that the Plan Commission recommended approval of the draft outdoor dining ordinance with the Village Attorney noted revisions.  Commissioner Di Iorio seconded, Ayes, all.  Nays, none.  Motion carried.

 

6.         Other Business.

Commissioner Jenkins stated that there was an interesting article on cell tower groupings in Northbrook and Wheeling within the Chicago Tribune approximately two to three weeks ago and the potential interference with local Police and Fire Department radios in Buffalo Grove.

 

The Plan Commission directed Staff to request information from the Village Attorney that relates to the 1996 Telecommunications Act for the next regular Plan Commission meeting.

 

The Plan Commission discussed the possibility of arranging a joint meeting with the Village Board for a date to be set in the New Year.

 

There was some discussion on potential text amendments that would be discussed at the next available special Plan Commission meeting.  The items that were brought up were driveways, bulk regulations, impervious lot coverage and establishing an institutional zoning district.  Plan Commission members were requested to forward any other potential text amendment subjects to Village Planner Cage.  Village Planner Cage would check to see if public hearing notices were published for these potential text amendments.  If the public hearings were commenced over six months ago then it would be prudent to republish a public notice. 

 

A special Plan Commission meeting would occur on November 18, 2003 only if the public hearing notices were published for these potential text amendments within the last six months.  If this was not the case then these items would be discussed at the first special Plan Commission meeting in January 2004.
