January 6, 2003 Meeting Minutes

 

Chairman present:  Fred Phillips.

 

Commissioners present: Joseph Di Iorio, Michael Dvorak, Nicholas Fasano, Camy Gould, and Lisa Phillips.

 

Commissioners Absent: Ed Acuna and Robert Jenkins.

 

Also Present: Village Planner Edmond Cage and Village Attorney Julie Tappendorf.

 

 

1.         CALL TO ORDER

Chairman Fred Phillips called the meeting to order at 8:05 p.m.

 

2.                  MINUTES OF November 4, 2003

There were some changes made to the draft meeting minutes from December 2, 2003 meeting minutes.  Commissioner Lisa Phillips motioned to approve the revised December 2, 2003 meeting minutes with the proposed changes, Commissioner Dvorak seconded.  Ayes, all.  Nays, none, motion carried.

 

3.         Approval of the Findings and Recommendations of the December 2, 2003 Meeting Re: T-Mobile Request to Install a Second Cellular Monopole at 5105 Arlington Heights Road.

 

Village Attorney Tappendorf had documented the findings and recommendations from the December 2, 2003 Plan Commission meeting when this petition received a recommended denial.  There were a couple of modifications to the finding and recommendations to clarify some items.

 

Commissioner Gould made a motion to approve the findings and recommendations for the December 2, 2003 Plan Commission meeting regarding the T-Mobile petition, Commissioner Fasano seconded.  Ayes, all.  Nays, none, motion carried.

 

4.         Continued Public Hearing For a Text Amendment and Special Use Permit to Operate a Day Care Center for Approximately 22 Children Within the Existing Residence Located at 7155 RFD (Lot #29 Towner Subdivision), Submitted by Dmitriy Makhovik.

Elliott Hartstein was present with the petitioner Dmitriy Makhovik.

 

Mr. Hartstein gave an overview of the petition and updated the Plan Commission on the parking study produced by Metro and the new landscape plan, both of these documents had been provided to the Plan Commission for their review.

 

Commissioner Gould asked why the traffic engineer, who produced the parking study, was not present at the meeting?

 

Mr. Hartstein stated that the study covered all the areas that the Plan Commission had requested and that he was available to answer questions on the parking study.

 

Commissioner Gould asked where the Institute of Transport Engineers numbers in the study came from?

 

Commissioner Lisa Phillips had spoken to the traffic engineer on the telephone about the study that was produced for this meeting.  The traffic engineer had stated on the telephone that the basis for the study was that all the cars do not come at the same time.

 

Commissioner Gould advised she had surveyed several day care facilities within the local area to get some comparisons of how drop-off and pick-up worked, what peak periods were, if any, and whether parking was an issue.  She advised these conversations seemed to support the petitioner’s position that, unlike preschools which had set start and end times, day care facility drop-offs and pick-ups were generally more staggered from 6:00-8:00am and 3:15-6:00pm, with peak periods between 7:15-7:30am and 5:15-5:30pm and that in general parking was not an issue, although some of the centers were near strip mall parking lots.

 

Commissioner Fasano noted that the traffic generated from the day care facility, according to the traffic engineer, will not adversely affect traffic on Route 83.

 

Commissioner Gould questioned whether the proposed 9-foot by 19-foot parking spaces were sufficient for this use considering that many families drive the wider SUV’s and would need additional space to open the doors to get children out of car seats.

 

Commissioner Fasano suggested that maybe these spaces could be reconfigured.

 

Village Planner Cage suggested using the parking space furthest to the west for compact car parking and the parking space furthest to the east for Sports Utility Vehicle parking.

 

Village Attorney Tappendorf suggested that this could be specified in any approval ordinance.

 

Commissioner Gould asked if there was a mountable median on this section of Route 83?

 

Village Planner Cage stated that there was a mountable median.

 

Commissioner Lisa Phillips asked the petitioner if a fire truck could gain access to this property?

 

Mr. Hartstein answered yes and that this had been addressed with the Fire District.

 

 Commissioner Fasano asked if there was documentation of this.

Village Planner Cage stated that the Village had received a letter from the Fire District and he would check to see if this letter had covered access.

 

Commissioner Fasano asked if the traffic engineer reviewed the driveway and parking lot widths and design and whether it would function in an acceptable manner?

 

Mr. Hartstein stated that the traffic engineer had reviewed this and it would work.  He also commented that the landscape/site plan would be modified to include the changes recommended by Village Planner Cage.

 

Commissioner Gould asked if the landscape plan meets the code requirements?

 

Village Planner Cage answered that the plan does meet the landscape requirements.

 

Commissioner Gould stated that her traffic concerns had been alleviated somewhat from her initial response due to the informal survey that she had conducted.

 

Commissioner Lisa Phillips still had concerns with traffic and safety at this location.

 

Commissioner Gould motioned that the Plan Commission recommend approval of a Special Use to permit a Day Care Facility to operate at 7155 Route 83 with the following conditions:

 

1.      That the Special Use is nontransferable and any proposed deviation or expansion of the facility or hours of operation or approved maximum capacity of 22 children will require an amendment to the Special Use.

 

2.      That "Drop Off Only" signage will be placed on the 5 parking spaces in front of the building and "No Parking" signage will be placed in the central driveway area and these parking limitations will be enforced.

 

3.      That a sign permit must be applied for and obtained prior to installation of any signage at this location.

 

4.      That the petitioner fully complies with all the required applicable regulations, including Countryside Fire Protection District requirement 4-7-1 for fire sprinkling systems.

 

5.      The petitioner must trim the hedges and landscape growth at the intersection of the driveway and Route 83 as minimally necessary to retain a landscaped barrier screening, but improve entrance and exit sight lines for safety and maintain these sight lines.

 

6.      That no additional trees will be removed from the site other than those (3) depicted on the plan without prior Village approval.

 

7.      That the site plan must be modified to include a reversible area to the west of the 5 parking spaces in front of the building so that vehicles can turn around with the aid of this area as opposed to reversing into the main driveway.

 

8.      The landscape plan must be revised to include 6 additional evergreen shrubs in between the 5 parking spaces and the front of the building and one additional canopy tree on the parking island to the south east of the parking lot area.

 

            Commissioner Di Iorio seconded the motion.  Ayes: Dvorak, Di Iorio, Fasano, Gould and Fred Phillips.  Nays: Lisa Phillips.  Not Present:  Acuna and Jenkins.

 

5.      Public Hearing for the Consideration of Text Amendments that would Modify the Requirements for Driveways, Impervious Lot Coverage Requirements and Create an Institutional Zoning District.

The public hearing was commenced by Chairman Fred Phillips at 9:38pm.  There was no public present to offer any comments.

 

The public hearing centered on the driveway regulations and possibly modifying the regulations so that they are clearer and are concentrated in one area of the code.  As Superintendent Block deals with the driveway regulations on a daily basis it would be appropriate for him to be present at the next meeting to aid the discussion.

 

Commissioner Fasano had some concerns that the new proposed regulations do not inconvenience or place a hardship on existing properties.

 

Commissioner Fasano made a motion to continue the public hearing to the next available Plan Commission meeting, Commissioner Dvorak seconded.  Ayes, all.  Nayes, none, motion carried.

 

6.          Plan Commission Scheduled Meeting Dates for 2004.

There was some discussion of the meeting dates for 2004.

 

Commissioner Lisa Phillips made a motion to approve the Plan Commission scheduled meeting dates for 2004, Commissioner Gould seconded.  Ayes, all.  Nays, none, motion carried.

 

7.         Plan Commission Scheduled Dates for Village Board Meeting Attendance.

A schedule had been drawn up for Plan Commission members to regularly attend the Village Board meetings.  The schedule was acceptable to everyone present, and if for some reason a Plan Commission member could not attend then Chairman Phillips requested that the Plan Commissioner call him and he would schedule to go in their place.

 

8.         Other Business.

Barbara Turner was present at the meeting and had some concerns about the Reilly property on Old McHenry Road developing and that the section of that property that will be conservancy should be preserved and that this should not be allowed to be counted as part of the subdivision/PUD overall acreage.

 

There was some Plan Commission discussion on whether to process residential developments as straight subdivisions or planned unit developments.
