January 20, 2004 Meeting Minutes

 

Chairman present:  Fred Phillips.

 

Commissioners present: Ed Acuna, Joseph Di Iorio, Michael Dvorak, Nicholas Fasano, Camy Gould and Robert Jenkins.

 

Commissioners Absent:  Lisa Phillips.

 

Also Present: Superintendent Block and Village Planner Edmond Cage.

 

 

1.         CALL TO ORDER

Chairman Fred Phillips called the meeting to order at 8:04 p.m.

 

2.                  MINUTES OF January 6, 2003

There were some changes made to the draft meeting minutes from January 6, 2004.  Commissioner Gould motioned to approve the revised January 6, 2004 meeting minutes with the proposed changes, Commissioner Fasano seconded.  Ayes, all.  Nays, none, motion carried.

 

3.      Continued Public Hearing for the Consideration of Text Amendments that would Modify the Requirements for Driveways, Impervious Lot Coverage Requirements and Create an Institutional Zoning District.

The public hearing was continued by Chairman Fred Phillips at 8:19pm.  There were no public present to offer any public comments.

 

The Plan Commission reviewed the revised and updated staff review.

 

Commissioner Acuna asked if this document addressed circular driveways?

 

Village Superintendent Block explained the concerns with the current driveway regulations and the reasons behind changing and updating these regulations.  He recommended combining sections #B and #E together and eliminating the verbiage “private street” from #B.  He also discussed some driveway examples within the Village that are causing various problems.

 

The public hearing centered on the driveway regulations and possibly modifying the regulations so that they are clearer and are concentrated in one area of the code. 

 

Commissioner Gould asked if the proposed 35-foot measurement in #C would work.

 

Superintendent Block stated that the 35-foot measurement works well.

 

Commissioner Gould questioned whether the word “width” in #C should be changed to “depth”?

 

Superintendent Block confirmed that the word “width” should be changed to “depth”.  He is also indicated that some diagrams should be included in the appendix to help clarify what the new residential driveway regulations mean.  He also stated that all residential driveways should maintain a minimum 5-foot setback from all property lines and that this was very important.  He also noted that the residential driveway regulations should allow concrete driveways.

 

Commissioner Gould asked if the Village wanted to include language regarding circular driveways as it was not included in this document?  Commissioner Gould requested that a section be added that limits lots of less than 1 acre to have one curb cut only.

 

Superintendent Block noted that these are regulated in the Subdivision Ordinance currently and should be relocated into the same new section on residential driveways.

 

Superintendent Block stated that within the building box, the homeowner has to comply with the impervious lot coverage regulations.  He also stated that the R.V. regulations are still in place and would not be affected by this proposed text amendment.

 

Commissioner Gould asked if such a text amendment was passed, would this burden existing properties with hardships?

 

Superintendent Block noted that the replacement of existing driveways that are non-conforming can take place if the driveway retains the same dimensions, but that any new driveways must fully comply with the proposed new regulations.

 

Commissioner Di Iorio stated that on lots of less than one acre, only one curb cut is allowed and no circle drive is allowed.

 

Chairman Fred Phillips suggested that Staff will revise the staff report and include appendix diagrams and bring it back to the Plan Commission at a future special meeting.

 

Commissioner Acuna made a motion to continue the public hearing to the next available Special Plan Commission meeting, Commissioner Dvorak seconded.  Ayes, all.  Nayes, none, motion carried.

 

 

8.         Other Business.

Chairman Fred Phillips provided the Commissioners an update on the day care petition that went before the Village Board on January 13, 2004 as he was present at this meeting.

 

Village Planner Cage updated the Plan Commission on the next regular Plan Commission meeting which has two new public hearings scheduled on the agenda.

 

There was some discussion on the potential institutional use zoning district, Superintendent Block suggested that this should be kept consistent with the BOCA Building Code definitions.

 

Commissioner Gould suggested that an institutional use zoning district be consistent with the current public assembly ordinance.

 

Village Planner Cage would coordinate with Village Attorney Tappendorf to produce a draft ordinance for the Plan Commissions’ review.
