June 1, 2004 Meeting Minutes

                                                                                                                                             

 

Commissioners Present: Ed Acuna, Michael Dvorak, Nicholas Fasano, Robert Jenkins, Karen Schultheis and Lisa Schultz-Phillips.

 

Commissioners Absent:  Joe Di Iorio and Camy Gould.

 

Also Present: Village Attorney Julie Tappendorf and Village Planner Edmond Cage.

 

1.                  Call to Order

 

Chairman Fred Phillips called the meeting to order at 8:00 pm.

 

2.         Approval of  May 4, 2004 2004 Minutes

 

Commissioner Fasano motioned to table approval of the May 4, 2004 minutes for later in the meeting, Commissioner Lisa Phillips seconded.  Ayes all, Nays none.  Motion passed. 

 

3.         Public Hearing to Consider a Request for a Special Use Permit and/or Any Zoning Relief Necessary that is Appropriate Under the Zoning Code That Would Permit the Construction of an Addition and Any Associated Remodeling of an Existing Nursing Home, located at 1666 Checker Road,

Submitted by The Arlington Rehabilitation & Living Center.

 

Chairman Fred Phillips swore in all present.  Petitioner Jimmy Mann provided certified return receipts to Village Planner Cage. 

 

Petitioner Sigmund Lefkovitz introduced their project which consisted of a one story addition that will use the same building materials as the existing building.  The overall size of the proposed addition would be 13,120 square feet.

 

Les Powell, of 1684 RFD, questioned if anything could be done to help pedestrian traffic along Checker Road from Arlington Heights Road and is there any consideration of adding a sidewalk in this area.  There is added concern with the proposed addition creating more traffic within this area.  Village Planner Cage will review the options when reviewing the updated plans for the staff report. 

 

Bill Blackburn, of 1647 RFD, noted that he is working on some issues with the Arlington for their regular property clean up.  These issues are:

 

·         Garbage – add some signs along Checker Road.

·         Evergreen trees – landscaping poor at the rear of the property and two trees need to straightened or replanted.

·         West side of building – some shingles missing and bricks out of place.

·         Prairie grass on berm – to the rear of the property, mainly thistle problems blowing into his yard.

·         Emergency generator – a sound issue and adding a barrier or a solid fence would solve the problem.

 

Mr. Blackburn stated that the Arlington has been good neighbors to this date.

 

Mr. Lefkovitz said there would be no new lighting proposed and that garbage would be kept in the same area.

 

Chairman Fred Phillips noted that no stucco and no siding would be permitted on the addition elevations.

 

Mr. Lefkovitz noted that the air conditioning units would be placed under new windows for the addition and stated that the daycare facility is no longer included in this petition.

 

Commissioner Acuna asked if the parking space issue with the Church was resolved and noted some traffic safety concerns in this area.

 

Commissioner Lisa Phillips confirmed that the proposed addition was approximately 14,000 plus square foot and that Staff look into approval ordinance for this project, review the proposed façade  materials and that the fence around generator should be reviewed to make sure it complies with the Village Code.

 

Commissioner Fasano asked if generator is set by a timer and Mr. Lefkovitz answered yes it was.  Commissioner Fasano felt that either the timing of the generator could be changed and/or screen it from view.  He also had some  landscaping and building material concerns.

 

Mr. Lefkovitz stated that they cannot match the existing façade’s materials, but would like to use brick if allowable.

 

Commissioner Jenkins questioned if impervious lot coverage is under 40% and if it complies with Code.  Village Planner Cage confirmed that it has been verified and is acceptable.

 

Commissioner Dvorak expressed concern that the addition bring unity to the existing building and that proposed materials are a big concern.

 

Commissioner Schultheis had a question on whether the actual use will change at all with the proposed addition.  Mr. Lefkovitz answered no.

 

Commissioner Schultheis had some concerns with the existing traffic and maybe add a stripe and a stop sign to warn users that they are entering onto Checker Road.  She also suggested that some landscape plantings by the building foundation would be a good idea.

 

Chairman Fred Phillips suggested that a dangerous intersection sign could be placed on Checker Road and asked Village Superintendent Block to check into obtaining such a sign for this location.

 

Commissioner Lisa Phillips noted that the south elevation as proposed is poor and brick should be the proposed material used along with some landscaping and possibly more windows to improve the façade.

 

Chairman Fred Phillips also expressed concern with south façade and agreed that brick materials should be used. 

The Plan Commission will look at another option submitted by the petitioner.  He also had some concerns with lighting from windows, window shades should be used to reduce such lighting.

 

Mr. Blackburn suggested that a trail or path would be a good idea to connect to the existing forest preserve on Checker Road.  He felt inclusion of natural landscaping is important.

 

Commissioner Fasano motioned to continue the item to the July 6th meeting, seconded by Commissioner Schultheis.  All Ayes, Nays none.  Motion carried.

 

4.      Approval of the May 4, 2004 Draft Meeting Minutes.

 

Commissioners Fasano, Lisa Phillips, Gould (in written form) and Village Attorney Tappendorf suggested some changes to May 4, 2004 minutes and these were discussed.  Commissioner Acuna motioned to approve the May 4, 2004 minutes with the noted changes, seconded by Commissioner Dvorak.  All ayes, Nays none.  Motion carried.

 

5.         Public Hearing on the Consideration of Zoning Text Amendments and/or Additional Relief Necessary and/or Appropriate Under the Zoning Code That Would Permit the Modification to the Sign Regulation Requirements.

 

Chairman Phillips opened the public hearing and there was no one present in the audience for this agenda item.

 

Commissioner Acuna had a concern with item number 10 and with the number of years, he questioned whether the setbacks needed to be 10 feet and questioned number 25 and the height of subdivision signs are a concern for him.  He requested that regulations only limit large inflatable balloons rather than the smaller ones.

 

Commissioner Lisa Phillips asked if garage sale signs required a permit and if there was an ordinance regarding garage sales.  Commissioner Schultheis requested that the regulations on garage sale signs should be specific.

 

Commissioner Lisa Phillips has some concerns with subdivision sign heights and that 8-feet was to high.

 

Commissioner Fasano has a big concern with number 10 on non-conforming signs.

 

Commissioner Lisa Phillips asked if the Village should be regulating attention getting sign or device and had some other issues with number 26.

 

Commissioner Jenkins had some concerns with some of the listed definitions.

 

Commissioner Dvorak had some concerns with number 23.1.

 

Commissioner Lisa Phillips motioned to continue the matter to the July 6th meeting, seconded by Commissioner Acuna.  All ayes, Nays none.  Motion carried.

 

6.                    Continued Public Hearing Regarding Non-Retail Uses in the Commercial Districts within the Village of Long Grove and to Discuss a Comprehensive Evaluation and Amendment to the Use Regulations within the Commercial Districts in the Village of Long Grove.

 

Commissioner Acuna provided the Plan Commission with a survey of the Historic Business District that listed 77 businesses, of which, 68 were retail uses.

 

Village Attorney Tappendorf suggested a stricter percentage on the first floor compared to the second floor.

 

Village Planner Cage summarized Commissioner Gould’s memo on the survey of the Route 83/45 area.

 

The Plan Commission discussed the appropriate percentage of non-sales tax generating businesses for the Historic Downtown and the overall consensus based from the survey was that 15% would be acceptable.

 

Village Attorney Tappendorf stated that the Plan Commission could use permitted uses and special uses to implement this requirement.

 

The Plan Commission felt that 40% of non-sales tax generating businesses for the Route 83/45 area was appropriate based upon the survey of that area of the village.

 

Commissioner Acuna made a motion to recommend that no more than 15% be non-sales tax generating businesses would be permitted in the B-1 Historic Downtown area and that no more than 40% non-sales tax generating businesses would be permitted in the B-2 Route 83/45 area.  Commissioner Dvorak seconded.  All ayes, Nays none.  Motion carried.
