                       October 5, 2004 Meeting Minutes

                                                                                                                                                       

Commissioners Present: Ed Acuna, Joe Di Iorio, Michael Dvorak, Nicholas Fasano, Camy Gould, Robert Jenkins, Lisa Phillips and Karen Schultheis. 

 

Chairman Present:  Fred Phillips.

 

Commissioners Absent:  None.

 

Also Present: Village Planner Edmond Cage & Village Attorney Tappendorf.

 

1.                  Call to Order.

Chairman Fred Phillips called the meeting to order at 8:00 pm.

 

2.         Approval of September 7, 2004 Minutes.

There was one change made to the draft minutes.  Commissioner Lisa Phillips motioned to approve the September 7, 2004 meeting minutes with the one change, seconded by Commissioner Acuna.  Ayes all, no nays.  Motion carried.

 

3.         Consideration of Proposed Subdivision Under the Village of Long Grove Code to Authorize a Straight Subdivision of the Existing Three (11.9 Acres) R1 Single Family Zoning Lots into Three DifferentlyConfigured Single Family Zoning Lots (Average Net Lot Size of 3.97 Acres) Located at 3332 Old McHenry Road, Submitted by Anastacio & Company. 

Jeff Braiman, representing the developer, Ruben Anastacio, provided an introduction to the project and how it differed from the previous submittal. Three single family lots were laid out on the plans, the 100-foot scenic corridor was illustrated on the plan and the cul-de-sac location had been modified from the previous submittal.

 

Chairman Fred Phillips requested a larger scaled plan as the details on this plan were hard to read.

 

Mr. Anastacio stated that lot 1 will be accessed from the private cul-de-sac road when the new house is built on that lot.  He also stated that a Home Owner’s Association will be formed for this subdivision.

 

Commissioner Di Iorio asked who would review the road width and the cul-de-sac radius.  Village Planner Cage answered that the Village Engineer and the Fire District would review these aspects of the development.

 

Commissioner Lisa Phillips questioned the design of lots 1 and 2.  She questioned the inclusion of the property to the northeast in lot 2, given that it was obviously an extension of lot 1.  Her concerns were based on maintenance of the property and the neighbor conflicts it could possibly create.  Mr. Braiman answered that the current homeowner in lot 1 is going to remain living on lot 1 during the construction of the other two houses.  Commissioner Gould suggested that this area could be designate open space, conservancy, or converted into an outlot.

 

Commissioner Lisa Phillips noted that the building box and septic field must be illustrated on lot 1 as with the other two lots.  She also had some concerns with the width of the road and the additional curb cut to Old McHenry Road which was not necessary.  Mr. Anastacio stated that the road width would be changed to whatever width is required by the Village.

 

Village Planner Cage noted that the neighboring Country Club had some concerns with the wetlands and therefore water concerns and drainage.

 

Commissioner Fasano recommended that the second curb cut be referenced to be removed and that a preliminary plat is needed for a submittal.  Village Attorney Tappendorf noted that the plan that has been submitted is a sketch plan and that a preliminary plat will be required.

 

Commissioner Jenkins also had a concern with the northeast section of lot 2 and the layout of the lots.

 

Commissioner Lisa Phillips noted that the building box on lot 1 is larger than the building boxes on the other two lots which both have a larger acreage than lot 1 which does not make sense.

 

Charlie Wachs, of 3376 RFD, suggested moving the private road to the southeast which would be a better and safer option.

 

Commissioner Dvorak favored the private road lining up with Prairie Wind Road across the street but is also concerned with the northeast area of lot 2.

 

Commissioner Gould echoed Commissioner Lisa Phillips concerns regarding the odd layout of the lots and would like the neighboring residences to be illustrated on the plans.

 

Commissioner Acuna had the same concern with the layout of the lots and that a redesign of the subdivision lots might be beneficial.  Mr. Anastacio suggested possibly making the northeast are of lot 2 a conservancy area.

 

Commissioner Schultheis asked if the developer was going to install a subdivision sign and Mr. Anastacio replied that he would not install a sign.

 

Commissioner Lisa Phillips requested that all the proposed driveways be added to the plan.

 

Village Planner Cage had two concerns, the private road width and cul-de-sac bulb and the northeast section of lot 2 which was poor lot design.  He also requested the developer consider adding a trail within the proposed subdivision.

 

Village Attorney Tappendorf noted that the petitioner must fulfill all the technical requirements as noted in the Village Code.

 

William Hoenig, of 3337 RFD, had some concerns with drainage and the wetlands.

 

Charlie Wachs, of 3376 RFD, would like to see the private road entrance be relocated further to the south.

 

Chairman Fred Phillips suggested that the petitioner make the appropriate changes to the plan and resubmit in time for the next Plan Commission meeting in November.

 

Commissioner Gould made a motion to continue the public hearing to the next available Regular Plan Commission meeting on November 2, 2004, Commissioner Jenkins seconded.  Ayes, all.  Nays, none, motion carried.

 

 

 

4.          The Affordable Housing Planning and Appeal Act and the Discussion of How the Village of Long Grove can Effectively Comply with the Requirements of this Act.

Village Planner Cage noted that the various articles included in the Plan Commission packet was in order to provide the Plan Commission with information on what other communities are working on in regards to this Act.

 

Village Attorney Tappendorf noted that a house worth less than $123,500.00 would qualify as affordable housing.  She thought it would be helpful for Staff to identify parcels that could be developed as affordable housing.  Some other options would be to amend the Village Code to accommodate affordable housing or provide incentives to developers to provide some affordable housing within new developments.  The most important aspect of the Act is that the Village must come up with a plan on how to address affordable housing within the community.

 

Chairman Fred Phillips asked if the dollar amount set for affordable housing would change over time.

 

Commissioner Lisa Phillips noted that the value of School District 96 and 176 would create immediate inflation of property values that would always be at issue.

 

Commissioner Schultheis noted that senior housing could be a possibility.

 

Village Attorney Tappendorf stated that currently the Village would have to comply with the law by 2009 and that a plan would need to be adopted by April 1, 2005.

 

Commissioner Gould suggested that the area to the north by Midlothian Road might be a good location because it is currently shown as multi-family housing within the Comprehensive Plan.  She felt that the Plan Commission needed to get a better feel on what options there are available to the Village.

 

Commissioner Fasano suggested looking at the fringe areas of the Village.

 

Commissioner Di Iorio suggested the possibility of annexing areas that would comply with the Act.

 

Village Attorney Tappendorf stated that the Act has 3 goals and they are:

1.       Affordable housing be 15% of all new development.

2.       Affordable housing be 10% of the current housing stock.

3.       Affordable housing stock be increased by 3%.

 

Chairman Fred Phillips suggested senior housing with smaller lots might be an option, this would eliminate the additional value that would be in the land for the property.

 

Commissioner Lisa Phillips noted that the Village of Long Grove does not have the infrastructure to support this type of development.

 

Richard Koenig who was in the audience, is a resident of Long Grove and an affordable housing developer.  He offered his expertise to the Plan Commission if they would like it.

 

Village Attorney Tappendorf suggested that the potential land be identified and then the Plan Commission could move forward with a template or an outline.

 

Commissioner Gould suggested that this subject could be investigated under the Plan Commission sub-committee items.

 

Commissioner Acuna suggested that a potential solution could be 2nd floor residences.

 

Chairman Fred Phillips suggested that this subject be discussed at future Plan Commission meetings as and when the agenda allows in order to form a plan by April 2005.

 

5.         Other Business

Chairman Fred Phillips outlined the sub-committee items and the need for a joint meeting with the Village Board.

 

Prospective meeting dates of October 19, 2004 and November 16, 2004 were selected for the joint meeting.

 

The next Plan Commission meeting would need to be held in a bigger venue than the Village Hall for the Menard’s petition.  As there is a conflict of election night at the school, the church might be another option.

 

Chairman Fred Phillips will not be available for the November 2, 2004 Plan Commission meeting as he will be out of town.
