Public Hearing to Consider a Petition Under the Village of Long Grove Zoning
Code for Amendment(s) to the Oak Creek Planned Unit Development and/or
Additional Relief Necessary and/or Appropriate Under the Zoning Code To Allow
The Installation of a Pool Within the Platted “Septic Field Area” at 4379 Oak
Creek Lane, Submitted by Mishail Shapiro.
Village Planner Hogue provided an update since the last meeting. The plat was revised and additional language was added. The updated plat and an assessment by the arborist is included in the Commissioners’ review packet.
Chairman Phillips inquired as to what will be done with the soil from the pool excavation. The petitioner stated that the soil from the pool will be hauled away. Commissioner Di Iorio stated that it is very important that the pool contractor adhere to the designated pathways, shown on the plat, during construction.
Commissioner Phillips questioned that if the septic field were to fail, if there would be enough space for another. The petitioner stated that there is 150% land available, which is 2 ½ times the necessary area.
Commissioner Acuna stated a concern for the temporary storage of soil on the site and the potential damage to the hickory trees, noted by the arborist, but not identified on the plat. The petitioner assured the commissioner that the trees would not be damaged.
Commissioner Acuna also had a concern regarding the prior meeting’s discussion to add wording to the plat to restrict further development of the woodland conservancy area which is restricted to 40%. Counsel Tappendorf pointed out that note 2 of the plat does limit further disturbance to the woodland conservancy.
Commissioner Phillips voiced a concern that residents of Country Club Estates may now wish to dig up their septic areas to build pools. Counsel Tappendorf clarified that the Plan Commission would never allow a pool to be built in the septic area. However, the Plan Commission would allow a pool in the absorption field area. In the current case, the absorption field area was eliminated. Commissioner Di Iorio further noted that septic areas can not be expanded into conservancy.
Chairman Phillips asked for other comments and Commissioner Di Iorio asked for additional clarification about the drawing. Chairman Phillips stated that the latest drawing needs to be changed to identify the absorption area as the septic area and the unmarked area is to be marked ‘absorption area’. Commissioner Rubin asked the petitioner how far the pool needed to be from the septic area. The petitioner stated 25’.
Commissioner Acuna motioned to recommend the petition under the Village
of Long Grove zoning code for amendment to the Oak Creek Planned Unit
Development at 4379 Oak Creek Lane, submitted by Mishail Shapiro, subject to
the following conditions:

Plat approved
2.
Review and
approval of the final engineering (drainage septic, etc.) by the Village
Engineer.
3.
There shall
be no stock piling of spoils from the pool.
4.
Conditions
specified in the letter dated July 26, 2005 from Urban Forest Management, Inc.
shall apply.
The motion was seconded by Commissioner Cohn. All ayes, no nays. Commissioner Phillips abstained. The motion carried.
The petitioner asked how soon the
plat needed to be modified for final approval.

Meeting
Commissioner Phillips stated that the Studio of Long Grove was granted a two week extension from today’s meeting because they were not ready. Commissioner Phillips questioned why the commission was making a special exception for this petitioner. Commissioner Phillips stated that he did not want to over-book the September meeting so he agreed to have a special meeting.
Commissioner Acuna asked if Commissioner Fraley should excuse himself from the next meeting due to a possible conflict of interest. Village Counsel Tappendorf stated that there is no legal conflict of interest.
Village Planner Hogue stated that 5 commissioners have committed to attend the special meeting August 16th and 6 commissioners are needed for a quorum.
Commissioner Acuna suggested that maybe since the agenda is light now the Plan Commission should start looking at sections of the new code. He suggested the commission start discussing the bulk aspects of the code, especially if there is time at the special meeting. Village Counsel Tappendorf stated that she has reorganized the code to make it more logical and changed those items which are challengeable. Commissioner Phillips stated that the board does not want the Plan Commission to start working on the code yet. She suggested that the commission wait until the code is complete and that the Commission is certain that the list of 21 items have been addressed with the re-write.
Commissioner Phillips objected to a special meeting for the petitioner. Village Planner Hogue stated that there was some confusion on the part of the petitioner regarding what was required for the meeting. When the petitioner was made aware of what was lacking, he made an effort to obtain the appropriate information, but there was insufficient time to complete the necessary paperwork. Commissioner Acuna asked if the Village’s requirements were clearly defined for the petitioner. Village Planner Hogue answered that he thought the petitioner understood at the time.
Commissioner Rubin said there is no urgency for this special meeting. Chairman Phillips stated that he responded to the petitioner’s request for a special meeting because the Village is trying to encourage downtown development.
Commission members were polled to determine availability for the August 16th meeting. It was determined that there will be a quorum.
